摘要
“能动履职”是进一步落实党的二十大提出的“加强检察机关法律监督工作”这一要求的新型检察理念,亦是新时代检察机关法律监督工作的基本趋向。基于对行政争议实质性化解案例的分析,检察机关在能动履职过程中呈现“强能动性”与“弱能动性”的形态界分。“以人民为中心”与“服务大局”两大司法理念共同形塑检察机关的能动履职形态。但是,检察机关在服务大局的过程中须与其他机关相互配合,受国家权力配置的功能适当性原则约束,进而形成“强能动性”与“弱能动性”的形态界分。推进检察机关能动履职,既需要建构基于程序法治的规范机制以及立体化的监督机制,防止检察机关能动履职异化;又需要从规范数字技术应用、完善协同机制等方面深化检察机关能动履职的保障机制。
“Actively duty performing”is a new procuratorial concept that responds to the demand of the 20th National Congress of the Communist Party of China to“strengthen the legal supervision of procuratorial organs”and is the primary trend of the legal supervision of procuratorial organs in the new era.Based on the analysis of cases of substantive resolution of administrative disputes,the procuratorial authorities have shown a distinction between“strong”and“weak”initiatives in performing their duties.The two judicial philosophies of“people-centered idea”and“serving the overall interests of the country”lead procuratorate to actively performing duties.However,in serving the country’s overall interests,procuratorial organs must cooperate with other organs and be bound by the principle of functional appropriateness in allocating state power,thus creating a distinction between“strong”and“weak”initiatives.To promote active performance of procuratorial organs,it is necessary to construct normative mechanism based on procedural rule of law and dimensional supervision mechanism to prevent bad changes of active performance of procuratorial organs.Moreover,it is necessary to deepen the guarantee mechanism of active performance of procuratorial organs from the aspects of standardizing the application of digital technology and promoting the collaborative mechanism.
