在中国共产党的领导、人民当家作主和依法治国有机统一之宪制逻辑中,全过程人民民主耦合了现行宪法“政权—人权—治权”之结构要素与核心命题。相应地,全过程人民民主塑造了人民当家作主的国家制度体系、架设了人权原则指引下的基本权利体系、建构了以人民为中心的国家权力体系。经由结构维度上的文义解释、时空维度上的历史解释和品性维度上的体系解释,可深入探察全过程人民民主的规范内涵。全过程人民民主之“进行式”定位决定其应在宪制功能与规范内涵指引下全面纳入宪法体制,通过纵向上的国家制度、枢纽中的基本权利和横向上的国家权力之体系建构,让民主的“人民性”、人民的“主体性”和人民民主的“全过程”得到全面塑造和深层涵养,推动中国特色社会主义民主与法治行稳致远。

In the constitutional logic of the integration of the leadership of the Communist Party of China,the people being the masters of the country and law-based governance,the whole-process people's democracy has interconnected with the structural elements and core proposition of the current Constitution of"political power-human rights-governance".Accordingly,the whole-process people's democracy has shaped the state system in which the people are the masters of the country,set up the basic rights system under the guidance of human rights principles,and constructed the people-centered state power system.The normative connotation of the whole-process people's democracy can be deeply understood through the textual interpretation in the structural dimension,the historical interpretation in the spatial-temporal dimension and the systematic interpretation in the character-based dimension.The"progressive"orientation of the whole-process people's democracy determines that it should be fully incorporated into the constitutional system under the guidance of the constitutional function and normative connotation,to make the"people-centered character"of democracy,the"status of masters"of the people and the"whole process"of people's democracy be comprehensively shaped and deeply cultivated through the system construction of the state system in the vertical sense,the basic rights in the hub and the state power in the horizontal sense,thus promoting the stable and long-term development of socialist democracy and the rule of law with Chinese characteri stics.
