环境法典编纂论纲

环境法典编纂以“人与自然生命共同体”为哲学基础,定位于“领域型”法典,采取实质性、适度化编纂模式,依可持续发展逻辑展开。总则编凝练核心范畴,建立现代环境治理体系与基本制度,实现环境权“入典”。污染控制编保障公众健康,依“污染控制”的理念确定调整范围、展开制度逻辑,解决新污染物控制问题。自然生态保护编以“自然生态”为基石概念,确立生态价值优先和统筹治理理念,构建契合生态整体保护的制度体系。绿色低碳发展编明确“绿色低碳发展”的规范涵义,实现相关规范的系统安排,统筹国内与国际、减缓与适应两大关系。生态环境责任编以理论创新奠定制度基础,构建“二阶型”法律责任体系,衔接《民法典》相关条款,建立专门纠纷解决机制。

Environmental codification based on‘a community of life for man and nature’and positioned as a‘domain-type’codification,adopts a substantial and moderate codification model and follows the logic of sustainable development.The General Part of the Code condenses core categories,establishes modern environmental governance system and basic institutions,and codifies environmental rights.The Pollution Control Part protects public health,determines the adjustment scope and the institutional logic according to the concept of‘pollution control’,and addresses the control of new pollutants.With the concept of‘natural ecology’as the cornerstone,the Natural Ecology Conservation Part establishes the idea of prioritizing ecological value and coordinated governance,and builds an institutional system fitting the overall ecological protection.The Green and Low-Carbon Development Part clarifies the normative meaning of‘green and low-carbon development’,makes systematic arrangements for relevant regulations,and coordinates the relationships between domestic and international,and between mitigation and adaptation.The Eco-Environmental Liability Part lays an institutional foundation with theoretical innovation,constructs a‘second-order’legal liability system,connects relevant provisions of the Civil Code,and establishes a special dispute resolution mechanism.
