摘要
在党务信息公开的司法审查中,党务信息的认定与党务信息的例外公开作为两个相对独立的问题展开。法院就其中党务信息的认定进行了去主观化的处理,回避对"党务"的实质解释,形成了以制作主体为核心的形式标准。党务信息的例外公开包括准用型例外公开与推定型例外公开两种模式,但无论是主动公开依据的划定、权利义务的性质以及"法"定职责的涵盖范围,都在极大程度上取决于党务/政务的前提性区分。党务信息公开裁判体现了法院在法律适用与政策执行上角色重合,需要通过党务信息认定中形式标准的实质化、党务信息例外公开实体规则的程序性审查加以调整。
In judicial review of party affairs information disclosure,the determination of party information and exceptions to disclosure of party information are two relatively separate issues.The court avoids the substantive interpretation of"party affairs"and form a formal standard centered on the subject of production.Exceptional disclosure of party information includes two models:quasi-exceptional disclosure and presumptive exceptional disclosure.The delineation of the basis for active disclosure,the nature of the rights and obligations and the scope of coverage of"legal"duties all depend on the prerequisite party/government distinction.The decision on party affairs information disclosure reflects the overlapping roles of the courts in the application of the law and the implementation of policy,which needs to be adjusted through the materialization of formal standards in the determination of party information and the procedural review of the substantive rules of exceptions to the disclosure of party information.
