体育环境侵权类型的重构

目前对体育环境侵权的分类仰赖于逻辑上的演绎和理论上的构建,缺乏对司法实践的考量,脱离现实的后果将对体育环境侵权这一新型案件救济不足。应当分析"侵害"与"权益"在相关实践中的各种表现,以重构体育环境侵权的类型。依据不同的侵害行为和受侵害权益性质,可将体育环境侵权的案件划分为体育环境污染行为损害个人私益的纠纷、体育环境污染行为或体育生态破坏行为损害环境公益的纠纷、体育环境污染行为或体育生态破坏行为损害个人私益与环境公益的纠纷,并适用不同的规则处理3种不同特点的案件。由于体育环境侵权案件类型的复杂性和体育运动的公益性,应探索体育环境司法专门化,同时运用多种柔性手段和社会化多渠道救济。

At present, the classification of sports environmental infringement relies on logical deduction and theoretical construction.It lacks consideration of judicial practice.The consequences of being out of reality will be insufficient relief for the new case of sports environmental infringement.The various manifestations of "infringement" and "equity" in relevant practices should be analyzed to reconstruct the types of infringement of sports environment.According to different infringement behaviors and the nature of infringed rights and interests, the cases of sports environmental infringement can be divided into disputes of personal environmental protection caused by sports environmental pollution behaviors, sports environmental pollution behaviors or sports ecological destruction behaviors, environmental public welfare disputes, sports environmental pollution behaviors or Sports ecological destruction acts to damage personal private interests and environmental public welfare disputes.Different rules should be applied to deal with cases with three different characteristics.Due to the complexity of the types of sports environmental infringement cases and the public welfare of sports, it is necessary to explore the judicial specialization of sports environment, and at the same time use a variety of flexible means and socialized multi-channel relief.
