摘要
境外仲裁机构内地仲裁政策的落地是法律全球化和本地化博弈中我国面临的现实选择,而选择背后的政策红利与风险将决定我国仲裁事业的发展前景。允许境外仲裁机构内地仲裁,将助力内地亚太仲裁中心建设并优化我国营商环境,进而促进我国法的域外适用。但政策落地同样也会对我国仲裁市场造成冲击,并在行政和司法层面产生相应风险。因此,通过强化司法监督的主导地位,加强行政支持力度实现内培外控将化解现有风险。而借助自贸区法治引领先行先试的改革经验,更能补益于《仲裁法》的修订,促进中国仲裁业的健康发展。
Allowing overseas arbitration institutions to arbitrate in the mainland is a realistic choice for China in the game of legal globalization and localization.The policy profit and risk behind the choice will determine the development prospect of China’s arbitration.Allowing overseas arbitration institutions to arbitrate in the mainland will help Shanghai to build Asia Pacific arbitration center and optimize business environment,thus promoting the extraterritorial application of China’s laws.However,the implementation of the policy will also have an impact on China’s arbitration market and produce corresponding risks at the administrative and judicial levels.Therefore,by clarifying the dominant position of judicial supervision of the court and strengthening the administrative support will help the local arbitration institutions grow and resolve the existing risks.With the help of the reform experience of the rule of law in the free trade zone,it is more beneficial to the amendment of the arbitration law and promote the opening and development of China’s arbitration.
