摘要
企业合规协议制度是解决工程建设领域高权行政监管模式实践困境的有效路径。我国虽然已经建成相对完善的工程建设法规体系,但是由于制度设计局限在传统的高权行政理念下,导致既有规定存在监管事项设置冗杂繁复、过程性监管措施缺位、监管责任主体错位等问题,造成了实践中的行政效能低下。对此,应当引入契约行政理念,通过工程建设领域企业合规制度建构,实现从"单一中心、单方强制、片面威慑"向"多元主体、多方协商、激励制约相融"的治理模式变革,并根据工程建设领域的特点,在适用范围、效力类型和司法救济三个方面展开构建。
Corporate compliance contract system is an effective way to solve the practical dilemma of high-power administrativesupervision mode in the construction engineering area.Although China has established a relatively perfect system of engineeringconstruction laws and regulations,the system design is limited to the traditional high-power administrative concept,which leadsto the existing regulations that have problems such as redundant and complicated regulatory matters,lack of procedural regulatorymeasures,and dislocation of responsibility subjects,which resulting in low administrative efficiency in practice.In this regard,the concept of contract-based administration should be introduced into this area,by the construction of corporate compliance system in the field of engineering construction,accomplish the transformation of governance mode from‘single center,unilateral enforcement,unilateral deterrence’to‘multiple subjects,multi-party consultation,incentive and restriction integration’,and according to the characteristics of the field of engineering construction,carry out the construction in the scope of application,effectiveness type and judicial relief.
