亲和关系是人证调查的基石,其在工作同盟的形成、社会影响的实现以及信息收集等方面均发挥着重要功能。关注、积极和协调是亲和关系的三个构成要素。为了确保人证调查目标的顺利实现,侦查人员应当依据拟对调查对象施以社会影响的类型以及上述各构成要素在特定社会影响类型实现中的地位和作用,采取有针对性的技术与调查对象建立亲和关系,并将之贯穿于人证调查的始终。在我国刑事诉讼程序的重心从侦查转向审判的当下,适时将亲和关系的建立和保持技术引入到询问和讯问等人证调查活动中,无论对于提升专门调查工作的质量、改进社会公众对刑事司法制度的认知还是探索构建以审判为中心的新型人证调查模式均具有重要意义。

Affinity is the cornerstone of witness investigation,playing an important role in the formation of work alliances,the realization of social influence,and information collection.Attention,positivity,and coordination are the three components of an affinity relationship.In order to ensure the smooth realization of the objectives of the witness investigation,investigators should adopt targeted techniques to establish a friendly relationship with the investigated object based on the type of social impact to be exerted on the investigated object and the status and role of the above constituent elements in the realization of specific social impact types,and apply them throughout the witness investigation.At the moment when the focus of criminal proceedings in our country has shifted from investigation to trial,it is of great significance to timely introduce the establishment and maintenance of affinity relationships into inquiry and interrogation and other witness investigation activities,whether for improving the quality of specialized investigation work,improving the public’s understanding of the criminal justice system,or exploring the construction of a new type of witness investigation model centered on trial.
