手机蜂窝通信功能价值影响标准必要专利许可费费基问题研究 被引量:7

Research on the Issues Concerning the Impact of the Value of Mobile Cellular Communication Functions on the Fee Base of Standard Essential Patent License Fees

摘要 手机作为重要的交流媒介,手机行业已经成为全球发展最为迅猛的行业之一。伴随着手机的功能多样化和差异化,不断改变手机行业的发展趋势,在此过程中,手机的通信功能价值也发生明显的变化,手机的非通信功能组件不断丰富手机的使用价值,而传统手机的通信功能组件的价值却不断弱化。这种现象也影响到现有标准必要专利许可费的费基测度,为此,考虑到现有的整个市场价值规则(EMVR)和最小可销售专利实践单位(SSPPU)极端理论的缺陷,本文提出真实的标准必要专利许可费的费基应介于两者之间(中间理论)。经过比较分析,中间理论该方法优于EMVR和SSPPU。本文分析为标准必要专利许可规则提供了新思路。 As an important communication medium,mobile phones have become one of the fastest growing industries in the world.With the diversification and differentiation of mobile phone functions,the development trend of the mobile phone industry is constantly changing.In this process,the value of the communication function of the mobile phone has also changed significantly.The non-communication function components of the mobile phone continue to enrich the use value of the mobile phone,while the traditional The value of the communication function components of the mobile phone has been declining.This phenomenon also affects the existing standard-essential patent license fee measurement.For this reason,considering the defects of the existing entire market value rule(EMVR)and the minimum marketable patent practice unit(SSPPU)extreme theory,this article proposes The actual standard essential patent license fee should be between the two(middle theory).After comparative analysis,the intermediate theory is better than EMVR and SSPPU.This analysis provides a new idea for the standard essential patent licensing rules.
