地方产业政策法治化的制度建构——以雄安新区传统产业转移升级为例

Institutional Construction of Local Industrial Policy Legalization——Take the Transfer and Upgrading of Traditional Industries in Xiong’ an New Area as an Example

推进传统产业转移升级是雄安新区高质量发展的关键阶段,但从当前产业转移升级的现状来看,存在着传统产业去留与高端高新产业布局困难的现实困境,反映出在地方限缩性产业政策与扩张性产业政策下法治保障缺失。雄安新区作为“创新之城”,透射出产业发展亟需正确处理产业政策与法治的关系,建立有效市场、有为政府,强调政府干预的法治化,让产业政策回归引导本义。具体而言,需要以功能性产业政策为主,主要通过程序性的地方立法,将产业政策纳入法治化轨道。在产业政策制定与实施中建立起民主决策制度、政策评估制度、问责制度等保障机制,运用法治手段划定政府与市场的边界,依法构建公平竞争的市场环境。

Promoting the transfer and upgrading of traditional industries is a key stage for the high-quality development of Xiong’an New Area.However,from the current situation of industrial transfer and upgrading,there is a real dilemma of the difficulty of traditional industries leaving or staying and high-tech industries layout,which reflects the lack of legal protection under local restrictive industrial policies and expansionary industrial policies.As a“city of innovation”,Xiong’an New Area reflects that industrial development needs to correctly handle the relationship between industrial policies and the rule of law,establish an effective market and a promising government,emphasize the rule of law of government intervention,and let industrial policies return to the original meaning of guidance.Specifically,it is necessary to focus on functional industrial policies and bring industrial policies into the track of legalization through procedural local legislation,and a democratic decision-making system,accountability system,policy evaluation system and other security mechanisms will be established in the formulation and implementation of industrial policies.The boundary between the government and the market will be delineated by means of the rule of law,and the market environment of fair competition will be built according to law.
