中国式现代化背景下经济法制度创新的方法论愈发重要。市场中层出不穷的新模式、新业态、新技术以及愈发复杂的既得利益问题增加了经济法制度创新的难度。对此,应在各地更多地开展经济法制度创新的竞争性试验。我国各地之间的这类竞争通常在中央的规划、指导、监督下展开,主要服务于全国而非地方目标,加之“制度竞争”存在语言学上的预设陷阱,因此传统的制度竞争理论应调适为中国式的竞争性供给理论。构建制度创新的竞争性供给机制,这是经济法守正创新的重要方式。

In the context of Chinese-style modernization,the methodology of innovation of economic laws is becoming more and more important.New developments such as various new models,new formats,new technologies,and increasingly complex vested interests in the market have exacerbated the uncertainty of economic and legal innovation.In the future,more attention should be paid to innovation through local institutional experiments.The introduction of competition is critical.The economic and legal innovation competition in various parts of our country is usually carried out under the planning,guidance,and supervision of the central government.It serves national goals.In addition,"system competition"has a linguistic preset trap.Therefore,the traditional theory of institutional competition cannot provide appropriate The theoretical explanation should be adapted to a Chinese-style competitive supply theory of economic legal experimentation and innovation.Building a competitive supply mechanism of institutional innovation is an important way for economic laws to innovate.
