On Legal Regulation of Rural Land Management Rights Market

摘要 体现"三权分置"改革精神的《农村土地承包法》,通过赋予土地经营权以独立性和高度流动性,为农地资源的市场化配置提供了有力的制度支撑,使土地经营权市场成为市场化配置农地资源的基本形式。土地经营权市场不仅因为市场失灵的存在而需要进行一般意义的法律规制,而且,因为其承载的特殊使命而需要进行特殊目的的规制,只有建立健全土地经营权市场规制性制度和机制,才能维护土地经营权市场秩序,实现农地的充分利用,促进现代农业的持续、稳定、高效发展。 The revision of the Law of the People’s Republic of China on the Contracting of Rural Land,which embodies the spirit of the"three rights"split reform,provides strong institutional support for the market-oriented allocation of agricultural land resources by endowing the independence and high mobility of land management right.The market of land management right has become the basic way of market-oriented allocation of agricultural land resources.The market of land management right needs not only general legal regulation because of market failure,but also special purpose regulation because of its special mission.Only by establishing and perfecting the regulatory system and mechanism of land management right market,can the market order of land management right be maintained,the full utilization of agricultural land be realized and the sustainable,stable and efficient development of modern agriculture be promoted.
