生态文明建设是关系中华民族永续发展的根本大计,需要环境资源法治体系的保障。习近平法治思想和习近平生态文明思想为环境资源法治体系的完善提供了思想指引和方法论指导。共同的理论渊源和问题面向使得二者在价值论和方法论上深度契合:即都体现了以人民为中心、以公平正义为生命线的价值观;建立了以系统观、整体观指导的方法论。在功能上,习近平生态文明思想深化了正义、秩序、文明等法的价值内涵;并通过对人与自然关系的深刻阐释创新了法律关系理论。习近平法治思想为生态文明建设提供了重要抓手。以习近平法治思想和生态文明思想为指导,健全环境资源法治体系应当从构建完备的环境资源法律规范体系,形成高效的环境资源法治实施体系,建设严密的环境资源法治监督体系,建立有力的环境资源法治保障体系和形成完善的环境资源党内法规体系五个方面来入手。

The construction of ecological civilization is fundamental to the sustainable development of China,and needs the support of the environmental rule of law system.Xi Jinping thoughts on the rule of law and ecological civilization provide ideological and methodological guidance for the improvement of the environmental rule of law system.The common theoretical origin and problem orientation make the two thoughts concord in value theory and methodology:that is,they both embody the values of taking the people as the center and justice as the lifeline,and both adopt systematic methodology.As far as the function is concerned,Xi Jinping Thought on Ecological Civilization has deepened the connotation of justice,order and civilization.Via the profound interpretation of the relationship between human and nature,it innovates the legal theory of legal relationship.Xi Jinping Thought on the Rule of Law has provided an important tool for the construction of ecological civilization.Guided by Xi Jinping thoughts on the rule of law and ecological civilization,the improvement of the environmental rule of law system should be achieved from the following five perspectives:the establishment of a complete environmental legal system,the establishment of an effective implementation system for environmental law,the establishment of a strict supervising system for environmental rule of law,the establishment of a strong supporting system for environmental rule of law,and establishment of a perfect inner-party regulation system for environmental rule of law.
