The Review and Prospect of the Research on Constitutional Review Since the Implementation of the Constitutional Law of 1982

现行宪法颁行以来,为推进合宪性审查实践,学术界开展了相当多的探索,主要聚焦于合宪性审查的功能、合宪性审查如何推进、案例中的合宪性审查等方面。这些研究为我国合宪性审查制度的推进提供了有力的智识支撑,形成了具有一定中国特色的学术话语体系,为今后的学术研究和合宪性审查实践的展开提供了有益的知识储备。今后我国的合宪性审查研究还需进一步拓展,应当关注立法、行政和司法中的审查,注重本土资源的发掘以形成具有世界影响力的制度实践和学术话语体系,注重与部门法的交叉研究和研究方法的创新。

Since the promulgation of the current constitution,the academic community has carried out quite a lot of explorations to promote the practice of constitutional review.They mainly focus on the function of constitutional review,how to push forward constitutional review,the case study of constitutional review and so on.These studies provided strong intellectual supports.An academic discourse with Chinese characteristics was formed.It supplied beneficial knowledge reserves for future academic research and the constitutional review practice.In the future,the study of constitutional review needs to be further expanded.We should pay attention to the review in legislation,administration and judicature;we should explore local resources to form the practice and the academic discourse with global influence;we should attach importance to the cross-study between the current constitution and the branches of law,and the innovation of research methods.
