我国民事诉讼基本原则的内在沟通逻辑

The Internal Communication Logic of the Basic Principles of Civil Procedure in China

我国民事诉讼基本原则内在逻辑不清,导致具体原则的司法适用和立法增减出现困境。基于商谈理论进行体系化研究,现代民事诉讼基本原则应充分体现全面理性的规范化再沟通这一民事诉讼本质,其内在的二元论片面逻辑可以整合为蕴含交往理性的商谈逻辑,并具体表现为三层关系:一是体现多元主体间自由平等沟通的起点原则,包括平等、处分、辩论原则;二是构成有效沟通先在要求的规范原则,包括“以事实为依据”“以法律为准绳”“诚实信用”“民族语言”原则;三是超越工具理性体现全面理性沟通的动力原则,包括法院调解、支持起诉和检察监督原则。我国民事诉讼基本原则体系以多元主体间自由平等再沟通为起点,以规范沟通为要求,以全面理性沟通为终极追求,具有内在的逻辑稳定性,这为民事诉讼基本原则的发展与适用提供了基本逻辑支撑。

The internal logic of the basic principles of civil procedure in our country is not clear,which leads to difficulties in judicial application and legislative increase and decrease of specific principles.Based on the systematic study of negotiation theory,the basic principles of modern civil litigation fully embody the essence of standardization and re-communication of comprehensive rationality,and its inherent dualism one-sided logic can be integrated into the negotiation logic that contains communication rationality,and is embodied in three-tier relationship.First,it embodies the principle of the starting point of free and equal communication among multi-party,including the principles about equality of litigation,disposition power and debate.The second is the normative principles that constitute the first requirements of effective communication among subjects,including the principles about“fact-based”,“law-based”,“honesty and credit”and“national language”.Third,the motivation principle that beyond the tool rational embodiment and embody comprehensive rational communication among subjects,including the principles about court mediation,support for prosecution and prosecutorial supervision.The system of basic principles of civil procedure in China starts from the free and equal re-communication between multiple subjects,takes standardized communication as the requirement,and takes comprehensive and rational communication as the ultimate pursuit.It has inherent logical stability,which provides basic logical support for the development and application of basic principles of civil procedure.
