论党内法规概念体系的构造与边界

On the Structure and Boundary of Conceptual System of Inner-Party Laws and Regulations

2019年新修订的《中国共产党党内法规制定条例》及《中国共产党党内法规和规范性文件备案审查规定》为党内法规概念的体系化创造了机会。综合考虑新规范对党内法规、党内规范性文件的界定及相关概念的发展历史、学术争议和现实使用状况,应以"党规"或"党内规范"作为党内法规概念体系的最上位概念,同时只在狭义上使用"党内法规",将其与扩张后的"党内规范性文件"一并作为"党内规范"的子集。"党的主张类文件"和"领导人系列讲话"则应列于党内法规概念体系之上(之外),前者突出其与国家法律的关系,后者强调其在党内的作用。

The newly revised Regulations on the Formulation of Inner-Party Laws and Regulations and Provisions on the Record and Review of Inner-Party Laws and Regulations and Inner-Party Documents in 2019 have provided an opportunity for the systematization of inner-Party laws and regulations concepts.Taking into account the definition of innerParty laws and regulations and inner-Party documents,and the historical development,academic debate and practical application of relevant concepts,we should regard"Party regulations"or"inner-Party laws and regulations"as the superordinate of conceptual system and understand it in a narrow sense.Together with the expanded"inner-Party documents",the concept"inner-Party laws and regulations"belongs to the category"inner-Party norms"."Party proposal documents"and"leaders’speeches"are supposed to be laid beyond the conceptual system of inner-Party laws and regulations.The former highlights its relationship with national laws,and the latter emphasizes its role in the Party.
