论中华法系的演进方向

代表中国封建时代法律制度建设总体成就的“中华法系”,是中国本土“法治主义”制度体系的集大成者,曾被世界公认为体现人类社会进步和制度文明的瑰宝。但中华法系毕竟是一个前现代的法律制度体系,必须在中华法系的要素构成标准方面作出新的探索,才有可能为“中华法系”概念的当代重构奠立基础。从主体与法治现代化的需求出发重新审视中华法系的根本意义和实践功用,将能够发现一个充满正向价值且能够对当代中国法治现代化建设大有助益的资源宝库。中华法系既构成中国人民自我认同的历史文化坐标,又是我们由以出发、创造新的制度与文化辉煌的重要基点和基础。在“要素性存在”意义上,中华法系的优秀成分不但没有消亡,而且会受到当代中国法治建设者的加倍重视,这些优秀的民族法治本土资源,通过创造性转化和创新性发展,能够很好地融入中国特色社会主义法治中去,从而实现中华法系全新意义的“要素化复兴”,这理应成为新时代中华法系的演进方向。

The Chinese legal family is the fruit of ancient legal development in feudal China and of the integration of China's local rule of law system,which is reeognized worldwide as a treasure embodying the social progress of mankind and institutional civilization.As a pre-modern legal family,new explorations on the standards of the elements of Chinese legal family should be made to lay the foundation for its modern restructuring of the concept of Chinese legal family.By re-examining the fundamental significance and practical utility of the Chinese legal family from the perspectives of its subject and the demand for a modernized rule of law,a treasure trove of resources full of positive value that can be of great benefit to the modermization of the rule of law in contemporary China will be found.It is not only a historical and cultural landmark that curves out Chinese people's self-recognition but also the basis for innovating and creating new institutions and culture.In the sense of"elemental existence",the best part of it is not lost in history but receives special attention in modern times,and these excellent indigenous legal resources of the nation can be integrated into the socialist rule of law with Chinese charaeteristics through creation and innovative development,which will finally contribute to a fully new elemental rejuvenation of Chinese legal family,this should be the evolution direction of the Chinese legal family in the new era.
