世界银行新旧营商环境评估规则及方法比较——兼论优化营商环境的道与术

世界银行推出了新的营商环境评估BR体系,从监管框架完备性、公共服务可及性、企业办事便利性三个维度进行评估,贯穿着环境可持续、推广数字技术运用及性别平等的理念。与原DB体系相比,BR删除了“环节”评估,在项目名称、指标内容、评估范围、评估维度、数据采集、注重规则的实施等方面,存在较大变化。世界银行将营商环境定义为企业无法控制的一系列条件,这些条件对企业整个生命周期中的行为有着重大影响。优化营商环境的要义在于,正确处理公共部门与市场主体之间的关系,以降低制度性交易成本为依归。根据党的二十大报告的要求,汲取中华优秀传统文化“不折腾”的智慧,本着道在日常、道法自然、道术合一的理念,确立优化营商环境的规则价值体系,为企业营造厚重宁静、公平透明、可预期的法律政策环境。

The World Bank has launched a new BEE system for evaluating the business environment,which assesses three dimensions:the completeness of the regulatory framework,the availability of public services,and the convenience of business operations,and runs through the concepts of environmental sustainability,promotion of digital technology use,and gender equality.Compared with the old DB system,BEE has deleted the"link"evaluation,and makes major changes in the project name,index content,evaluation scope,evaluation dimension,data collection,and implementation of rules.The World Bank defines business environment as the set of conditions outside a firm's control that have a significant influence on how businesses behave throughout their life cycle.The essence of optimizing the business environment is to correctly deal with the relationship between the public sector and market entities,with the aim of reducing institutional transaction costs.According to the requirements of the report of the 20th National Congress of the Communist Party of China,absorbing the wisdom of"no z-turn"from the excellent traditional Chinese culture,based on the concept of Taoism,it is necessary to establish a rules and value system for optimizing the business environment to create a peaceful,fair,transparent and predictable legal policy environment.
