高校学生资助法治化:属性厘清及路径优化

高校学生资助法治化是依法治教和依法治校的基本要求,而完备的法律规范是高校学生资助法治化的前提.相对于高校学生资助实践,高校学生资助理论研究和法律制度供给明显滞后,其中,资助法律属性有待厘清,资助管理机构、资助资金管理、资助信息管理、资助评审机制、资助程序和监管责任亟需依法规范.在厘清高校学生资助的行政给付性质基础上,应当确立教育公平、隐私保护和资助育人的法治化理念,构建高校学生资助的实体规范和程序规范,建立高校学生资助监督和纠纷解决机制,推进依法资助,进而实现资助资源合理配置和教育公平的目标.

It is a basic requirement of managing education and school by law to legalize the college student financial aid,while a complete legal regulation is the premise of the legalization.Compared with the practice of financial aid to college students,the theoretical research and legal system supply of college student financial aid lag behind.On the one hand,the attribute needs to be clarified,on the other hand,the management agency,the funding management,the information management,the assessment mechanism,the procedure as well as supervision responsibility remain to be standardized according to the law.Due to the administrative presentation attribute of college student financial aid,the main content of legislation on college student financial aid is to establish the concept of education fairness,privacy protection and education aid,construct substantive and procedural rules of college student financial aid and establish a mechanism of supervision and dispute resolution for college student financial aid.The legalization of college student financial aid is not only condutive to ensuring the reasonable allocation of aid resources and education fairness,but also of great significance to the modernization of educational governance.
