案例指导制度中的案例适用问题

Application in Case Guidance System

建立案例指导制度的主要作用和目的是为了统一法律适用标准、指导下级法院审判工作。当案例指导制度进入运行时,指导性案例的适用需要具备一些条件,这些条件应该是:案件审理缺乏具体的制定法规范;存在具体的指导性案例规则;具有相似的案件事实。同时,指导性案例的适用还需要具备一些必要的技术,这些技术应该是:案情比对,情势权衡,指导性案例的遴选,规则引用,指导性案例的排除。
