摘要
物权法将"合理价格"作为单独构成要件的意义并没有在司法实践中得到凸显,反而出现了法律规定与实践不相符之处。保证法律规定与司法实践的统一",合理价格"作为判断受让人善意与否的一个或然性标准,已无单列法条之必要。应秉承传统民法之理论,将"合理价格"定位于买受人的合理注意义务。但这种注意义务不得扩大至可能对物权其他原则的背离。对善意的判断也应综合其他因素辅之以"合理价格"加以考量,以符合善意取得制度设立之初衷,维护司法判决的统一和交易的安全与顺利。
Property Law with 'rational price' as independent component is not manifested in judicial practice but discordance between rules of law and practice to secure the agreement between the rules of law and judicial practice.'Rational Price' is not necessary to be in separate rule as alternative standard to judge whether assignees are benevolent or not.We should follow the theory of traditional civil law and set 'rational price' assignee's duty of care.However,such a duty of care shouldn't be expanded to alienate property law from other principles.The judgment of kindness should be integrated with other factors subsidized by 'rational factors' for consideration to accord with the system initially instituted out of kindness and maintain successful judicial verdict and transaction.
