New Theory on the Nature of the Community Correction

社区矫正的性质关乎其今后的发展方向,面临我国现阶段社区矫正的发展现状,必须对社区矫正的性质进行准确定位。从处遇的定义、社区矫正的理论根基、有关社区矫正的官方判定及法律规定、社区矫正的实际需求、国外经验等角度分析,将其认定为一种综合性的非监禁处遇措施为宜。

The property of community correction is relevant to its orientation in the future.In accordance with the practice of community correction in our country,we should specify the property of community correction definitely.Therefore,we consider some issues about community correction,including the property of treatment,the original theory of community correction,the statutory provision of community correction in our country and the needs of the new-identified property of community correction and experience of community correction in abroad.We finally draw a conclusion that it is better to consider community correction as a comprehensive non-institutional treatment.
