摘要
产品责任 ,是指因产品存在缺陷而造成他人人身财产损害而引起的赔偿责任。在采用严格责任归责原则的情况下 ,对产品缺陷的鉴定显得尤为重要。产品责任法的初衷是最大限度内保护受害者的利益 ,不但包括基本的保护 :减小受害后获得的赔偿的阻力 ;而且应当包括根本的保护 ;通过惩罚性赔偿来减少缺陷产品的产生从而减少损害的发生。因此我们应当对惩罚性赔偿做一些思考。
The product liability means the compensation liability for the product's defect which causes damages on others' body or/and property. With strict enforcement of the doctrine of liability fixation, it is important to identify the product defect. The original purpose of Product Quality Law is to protect the victims' benefits as much as possible. Included are both the essential protection of decreasing the resistance to compensation after damage and the ultimate protection of adopting chastening compensation to decrease the appearance of defective products.
