摘要
无论是从马克思恩格斯的法律观中 ,还是从西方法治的发展变革中 ,都会看到浓重的法律“人本精神”。然而 ,由于多种因素的影响 ,我们的依法治理进程中却出现了法律工具理性的扩张 ,从而迷失了“人本精神” ,因此 ,摒弃法律工具主义和实用主义 ,弘扬法律的“人本精神” 。
The strong human-centered spirit of law can be read both in the legal conception of Marx and Engles and in the development of western rule of law. However, due to the influence of various factors, the extension of the legal instrumental reason has appeared in our building of governing by law, consequently the human-centered spirit has been lost. Therefore, the most important thing is to discard the legal instrumentalism and pragmatism, and finally to enhance the human-centered legal spirit.
