摘要
在我国《商标法》中对原产地名称 (地理标志 )实行了法律保护。商标法关于原产地名称的商标保护、反不正当竞争法关于不正当竞争行为的规定以及相关法律、行政法规规定具体的保护措施共同构成了我国法律对原产地名称的保护。本文在归纳了上述法律法规的保护措施的基础上 。
The Trademark Law of China provides legal protection for original appellations. Trademark protection provided by the trademark law,regulations and relevant laws against unfair competition and the specific protective measures stipulated by administrative regulations jointly protect the original appellations in China. This paper summarizes the above-mentioned legal protective measures,analyzes the problems in the legal protection of original appellations in China and offers some suggestions for the betterment of Chinese original appellation protection law.
