On Defining Public Interest

公共利益是土地征收的唯一合法正当理由,其内涵的界定是土地征收的关键因素。通过评析各学说对公共利益内涵的界定,并在此基础上提出公共利益的考量公式,期望对完善我国土地征收制度有所启示。

Public interest is the sole proper and legitimate reason for land condemnation; and properly defining its implication thus becomes a decisive factor of land condemnation. Based on analysis of the definitions given by various schools of thoughts, this article gives its own definition of public interest and advances its evaluating formula in order to help in perfecting our country's land condemnation legislation.
