摘要
通过质疑诉讼和解论的可行性,分析处于现代化和社会转型背景下的中国社会纠纷解决的现实,阐明法院调解制度在法制化进程中的特殊价值,以对当前法院调解制度改革有所裨益。
This article clarifies the special value of mediation in the process of building modern legal system,through arguing against the opinion that mediation should be taken place of by settlement of action,and through analyzing the practical need of China with modernization and social transformation in the background.
