律师辩论的“人际意义”研究

本文从功能语法的人际元功能出发,分析律师辩论的语言特点,力图揭示律师发言体现的人际意义[“情态”(modality)和“评价”(evaluation)],以及这种人际意义对作为庭审第三方的法官产生的影响。分析语料为一场精彩的律师电视辩论。怎样使用恰当的语言保护当事人的合法权益是律师的职责,本文表明恰当使用“情态”和“评价”传达人际意义,对律师在辩论中取胜至关重要。掌握“情态”和“评价”的用法是律师提高语言能力的重要方面之一。

In this paper, an extract of judicial debate is analyzed within the framework of functional grammar ingeneral, and the perspective of interpersonal function in particular. Judicial debate, being counsels’ born-duty toprotect clients’ lawful rights, plays a key role in realizing legal justice. The author of this paper chooses data from aTV contest for counsel debate, and analyses the interpersonal function (modality and evaluation) that the dataconvey. In legal settings, judicial debate is mainly demonstrated for judges or juries in order to influence their thoughtsin deciding the case. This article manifests that ‘modality’ and ‘evaluation’ are crucial for a counsel to win judicialdebate, the skillful manipulation of which determines counsels’ improvement of their language skills.
