Several Issues on the Reform of Investigatory Supervision System

司法体制改革应进一步强化检察机关的法律监督职能。具体到侦查监督制度改革而言,应当强化对侦查的监督制约,强化侦查监督的启动程序效力,保证更加有效地维护司法公正和人权。因此,侦查监督制度改革的基本思路和主要设想是:拓宽检察机关对刑事立案、侦查活动的知情渠道,增强其发现违法的能力;增加检察机关开展监督的手段,提高侦查监督的实效;完善监督程序,为开展监督提供程序保障;完善监督范围,使侦查监督体系更加严密。

The function of legal supervision of the procuratorial organ shall be further enhanced in the judicial reform.Concretely in the reform of investigation supervision system,restriction and control of investigation and the validity of initiating proceedings should he strengthened to guarantee more effective protection of judicial impartiality and human rights.Therefore,the reform of investigatory supervision should conform to following primary methods:developing the channel to know concerning placing criminal cases on file and investigation to increase the capacity of malfeasance discovery;augmenting procuratorial measures of supervision to improve actual effect of investigatory supervision;completing supervisory proceedings to provide procedural guar- antee for supervision;and defining the scope of supervision to make the system more strict.
