摘要
我国的经济体制决定了土地的所有权归国家所有。由于现行法对于出让土地使用权规定了较短的期限,客观上会造成其与地上建筑物所有权的恒久性之间的冲突。而国家所有权优位等理念使得我国现行立法以“无偿收归”国有的方法解决这一冲突,这很不利于公民财产权的保护。本文从传统“越界建筑权”及“主权利与从权利”的理论出发,提出了建立“法定续约权制度”以解决这一矛盾。
The economic system of China determines the land belongs to the country. As the law provides a short deadline about the private to possess the right to use of land through purchasing, then there inevitably induces the conflict between the limitation of the right to use of land and the time indefinite duration of the ownership of the building on the land. This article analyze the rationality of the law provision to settle this problem through “confiscate”, and discuss to constitute the system of legal continuous of the contract on the basis of the “right of overstep the boundary buildings” and “the principal right and the secondary right”.
