中外企业法律形态比较和借鉴

Use as Reference and Make a Contrast of Law Formation between Chinese and Foreign Enterprises

我国已经确立了社会主义市场经济体制,应当借鉴和采用市场经济通用的企业形态模式,采用一元化的立法标准。但是目前我国企业法律形态设计存在企业主体的独立性不高、具体形态缺乏等缺陷。本文比较世界各国企业法律形态,分析我国企业法律形态设计的具体缺陷,并且提出了完善我国企业法律形态设计的建议。

The socialist market economic system has been established, but shoud use as reference and adopt the common enterprise mode of market economics and centralized legislation standard. However, there exist some defects as weak independence in enterprise law formarion, lack of concrete formation , etc.. This paper makes a contrast of the enterprise law formation of foreign countries, analyzes the concrete weakness of ours, and puts forward some suggestions for the perfection of our enterprise law formation.
