刑法学中职务犯罪概念及构成特征分析

Analysis on the Concept and Formative Characteristics of Duty Crime in Criminal Law Science

多年来,法学界所形成的关于职务犯罪的研究成果已十分丰富。文章介绍了目前较为典型的几种职务犯罪概念,并在借鉴与分析的基础上,对刑法学中的职务犯罪概念作出了重新界定。职务犯罪的构成特征表现为:职务犯罪侵犯的客体具有复杂性;职务犯罪的客观特征是行为的职务关联性和表现形式的多样性;职务犯罪在主观方面既可表现为故意,又可表现为过失;职务犯罪的主体为特殊主体。

For many years, there are a lot of research achievements on duty crimes in the field of law science. This article introduces several typical concepts of current duty crime, and defines it again on the basis of learning and analyzing it. The formative characteristis of duty crime are ： the object duty crime violates is complex; the objective characteristics of duty crime are its relevence to duty and variety of forms; duty crime can be on purpose or be by mistake in subjectivity;the subject of duty crime is special subject.
