日本法人类学及民族法学研究的历史与现状

History and Present Condition of Legal Anthropology and National Law in Japan

本文对一百年来日本法人类学以及民族法学的发展过程及研究水平作了较为系统的介绍。指出,战后受德奥学术传统影响,形成了民族法学的使用习惯,受美国学术思想的渗透,形成法人类学的术语,与民族法学并用,各有所重。文章对20世纪80年代以来日本学者有关中国民族法制建设的研究状况进行了评述,指出日本对中国民族法的调查研究成果南方多于北方。

This paper makes a brief introduction to the development and research level of legal anthropology and national law in Japan. It is pointed out in this paper that influenced by the academic tradition of Germany and Austria, national law came into being and influenced by American academia, terms of legal anthropology began to form. Legal anthropology and national law are laid equal stress on and each of them focuses on different areas. This paper makes a review of the research condition of national legal system construction done by Japanese scholars since 1980s. The research achievements about south China surrpass north China.
