实行案例指导制度是要以制定法为主、案例指导为辅,在不影响制定法作为主要法律渊源的前提下,借鉴判例法的一些具体做法。案例指导制度蕴涵着以下法律价值:节约司法资源,提高司法效率;保障法制统一,实现司法公正;发挥司法功能,积极解决纠纷;提高司法能力,遏制司法腐败。实行案例指导制度,是我国法制实践提出的迫切需要,是一种能够体现中国特色、并顺应世界两大法系逐渐融合发展大趋势的制度变革举措。

The case directing system means to take statute law as the main body assisted by directive cases, so we could take reference of some methods of case law system without influencing the statute law as the main legal source. The case directing system involves many legal values as the following： saving judicial resources and enhancing judicial efficiency, maintaining the unity of legal rules and achieving judicial justice, making use of judicial functions and settling disputes actively, improving judicial ability and restraining judicial corruptions. Our current practice of legal system cries for the implementation of the case directing system. This kind of reforming measures on the rules reflects not only the Chinese characteristics, but also the general tendency of the gradually integrating development of the two legal systems in the world.
