法律移植的隐喻应在广义上使用。在全球化背景下,全球治理和国际法治的理念开始形成并得到强化,全球法律的地方化和地方法律的全球化对民族国家的法治模式提出新的挑战。这些新趋势对法律移植产生了重要影响。面对这些新的变化,法律移植的理论范式应得到发展。对不同类型的社会应当适用不同的法律移植理论范式:对初民社会适用文化范式,对国家产生后和现代社会前的传统社会适用政治和文化范式,对民族国家阶段的现代社会适用政治范式,对全球化时代的社会适用经济、政治和人类共同价值范式。

The metaphor of legal transplant should be used in a broad sense. In the process of globalization, concepts of global governance and rule of international law began to take shape and gain force. The localization of foreign laws and globalization of local laws pose a challenge to the governance models of nation states. These new trends have a great impact on legal transplant. Theoretical paradigms of legal transplant should be adapted to answer these new challenges. They vary with different types of societies: a cultural paradigm for primitive society, a political and cultural paradigm for traditional societies between the formation of the state and the coming of modern age, a political paradigm for modern society at the nation-state stage, and a paradigm that combines the economic and the political with common human values for a globalized society.
