建筑市场的激烈竞争和工程施工的特点导致当前大部分施工企业都面临着施工利润薄、风险大、工程款拖欠、施工索赔等问题,文章从加强管理、规避风险、清收工程款及有效索赔四个方面阐述施工企业中如何正确运用合同法加强合同管理予以应对。

The keen competition and construction characteristics in construction market lead to so many problems for most construction enterprises, to wit： less profit and higher risks, late payment of due amount for the project, construction claim, etc. From four points of view as strengthening management, avoiding risks, clearing ＆ receiv- ing payment and making effective claims, this paper illustrates how the construction enterprises should properly apply with contract law to strengthen contract management and what they should hereby pay attention to.
