在涉外民事诉讼中,先决问题具有独立地位,并对主要问题具有制约性;选择其准据法时,应适用与先决问题有最密切联系的国家的冲突规则。

In international civil procedure, the preliminary question has the independent position and restrictions on the principal question. The judge should apply the conflict rules of the country which has the most significant relationship with the preliminary question to choose the applicable law of the preliminary question.
