The Statutory Period after Which Security Interest Cannot Be Claimed for

担保物权虽无适用于自身的诉讼时效,但在主债权诉讼时效完成时,无论由第三人或者债务人本人提供的担保物权,也不论是不移转占有或者移转占有的担保物权,都将因主债权时效完成而消灭。为了保护物上保证人以及担保物上的后顺序担保物权人与一般债权人,担保人可以和债权人约定担保物权期间,在主债权诉讼时效完成前,担保物权可因期间届满而消灭。

Though no limitation is specially prescribed for security interest, where the limitation period for the principal creditor ends, the security interest shall expire no matter it is offered by the third party or the debtor or it is transferable possession or nontransferable possession. A guarantor may enter into an agreement with the creditor on a period of the security interest to the effect that the period may expire even if the limitation period for the principal debt is not over. Thus, the guarantor who gives security for the debt with his property, the creditor whose security interest is postponed and general creditors will be better protected.
