摘要
所有权变动不破租赁是在买卖不破租赁制度的理念上扩展而来的一个命题。我国现行"买卖不破租赁"制度的构成要件已经造成以弱凌强,过分偏重于保护承租人而侵害了新所有人的利益,应当在侧重保护承租人利益的基础上使用利益平衡的理念对其加以矫正。定期租赁合同应当在登记公示后,租赁权取得对抗新所有权的效力。
The notion, property rights change in continued rents, derives from the idea of continued rents in the process of selling, The present system in our country is so irrational practically that it lays excessive protection on the lessee while violating the new owner' s benefit. So it becomes necessary to introduce the notion of benefit balance on condition of protecting the lessee' s benefit. Usually after regular rents contract registered, the right of rent stands prior to new property right.
