摘要
我国的教育体制改革已经使传统的教师与政府、学校之间的法律关系发生了根本性的变化,教师职业的性质正逐步由过去的国家干部转变为专业人员。但教师职业实现专业化还需要一个长期的过程,其中,法律制度的设计和实施对实现教师职业的专业化发挥着关键性的作用。我国的相关法律制度已经比较完善,但《教师法》对教师法律地位的规定过于笼统,在法律的适用上还存在一些有待研究和解决的问题。
Chinese Educational system reform has made fundamental changes in the legal relationship among the traditional teachers, government and schools. The trait of teachers' occupation has gradually turned from government officials into professionals. However, it is still a long process for the teachers' occupation to realize professionalization, among which the design and implementation of legal system are playing a key role. The Chinese related legal systems have already been perfect. But the regulation of teachers' legal status in the "Teachers' Law"is too general and there are still some problems to be solved in legal application.
