摘要
《物权法》149条第1款规定的原则性很强,在实践中还存在一些问题有待研究和明确。依据立法精神并结合现行制度和社会现实,通过出让及其后的依法流转方式取得住宅建设用地使用权,期满自动续期时不宜再向权利人收取具有对价性质的费用;该条款对于外国人在我国住宅的适用不必要也不应该做出限制性或排除性的特别规定;至于该款规定是否适用于"住宅商用"的商铺和未建造住宅的空地则应根据实际情况区别对待。
The stipulation of Article 149 of the Real Right Law has strong sense of principle, so it is necessary to make a further study of some issues in the practical application of the article. According to the legislative spirit and the existing laws and social environment, when the term of the right to use construction land for dwelling houses expires, it shall be renewed automatically and the granting fee is not asked to be paid again; generally speaking, the stipulation should also be applied to the foreigners' dwelling houses in our country ; whether the stipulation is applicable to" store" or" vacant land" depends on specific situations.
