摘要
2001年我国对《中华人民共和国婚姻法》进行了修订,其中对夫妻财产制度作了重要的修改和完善;此后随着《中华人民共和国公司法》、《中华人民共和国合伙企业法》的修订以及《中华人民共和国物权法》的颁布,使夫妻财产制中财产的形态、类型以及财产的内容都发生了重要的变化。因此,从夫妻财产制的类型、夫妻共同财产的范围、夫妻财产形态的变化、夫妻共同财产的分割及相关的法律冲突与协调等方面对婚姻法视野下夫妻财产制的内容进行分析和探讨具有十分重要的意义。
In 2001, our government modified The Marriage Law of People＇s Republic of China, of which bona conjugun system has been made important modification and improvement. Afterwards the modification of The Company Law of People＇ s Republic of China, The Law of Property Right of People＇ s Republic of China, and the decree of The Limited Liability Partnership Law of People＇ s Republic of China led to great changes in the pattern, type and content of property. This paper intends to analyze and discuss the bona conjugum system from the perspective of its type, scope, change, division and the relative lawful conflict and coordination.
