摘要
我国农村宅基地使用权法律制度存在一些缺陷,其立法基础和标准不统一,导致现行相关法律规定相互矛盾。我国应确立完善的农村宅基地使用权登记制度,逐步建立农村宅基地有期限、有偿使用制度,在条件成熟时以立法形式规范农村宅基地使用权的流转。
The legal system for the right to use the rural residence land in China has many deficiencies, and the disunity of its legislative basis with the standards leads to the contradiction of current relevant laws and regulations. China should establish a sound registration system for the right to use rural residence land and gradually sets up a system for limited and compensated use of rural residence land. When conditions mature, the transfer of the right to use rural residence land will be standardized in the legislative form.
