评经济法学研究中的“法外论法”

A Brief Review to the Extra-angle of Law in the Science of Economic Law

基于经济法的内在特性和特定背景,经济法学研究格外重视"法外论法"。经济法学研究30年的实践中,"法外论法"既已展示出在注重法律规范的基础上保持认知开放性,遵循"问题取向"以多种方法解决问题的优势,也已显露了知识筹备和学术训练不足的劣势。在今后的经济法学研究中,有必要处理好"法外论法"与"就法论法"和法学品格之间的关系。

Based on the inherent characteristics and the specific background of Economic law , the science of Economic Law paid special attention to the Extra - angle of law. In the recently 30 years ＇ research practices of the science of Economic Law, on the one hand Economic law focuses the advantage of the ＂problem -orientation＂ in a number of ways to solve problem and emphasis on the basis of legal norms to maintain the openness of Cognition; on the other hand it also has disadvantage of the insufficiency of Knowledge of the Preparatory and academic training. In future study of the science of Economic Laws it is necessary to properly handle the relationship between the Extra - angle of law and the Internal - angle of law, or the Extra - angle of law and Law character.
