摘要
在土地承包经营权流转中,发包方同意作为对流转的一种限制,其规范地位在不断弱化。此限制无法从法体系中合乎逻辑地推导出来,限制的背后是法政策的考量。这是阐释发包方同意作为土地承包经营权流转之限制需要确立的框架。这种法政策的考量并非是土地承包经营权的保障性,两者无法形成对应关系。事实上,发包方同意是以基层政权与村社共同体成员之间的结构性利益分离状况下的国家治理方式作为法政策基础的,随着国家治理方式的变化,发包方同意这个限制也应随之改变。因而,对发包方同意的考察应从治理的视角着眼。
In the circulation of the right to the contracted management of land, the status, which the restrict of ontract -letting party' s consent has,is being weakened continually. The restriction can' t be deduced logically from the system of law, so the consideration of legal policy is in the back of this restriction. But this consideration isn' t the guarantee of the right to the contracted management of land, this guarantee and this restrict also can' t form a relationship of correspondence. In fact,the foundation of this restrict is the mode of state' s governance to the rural society. Along with the change of this mode, this restrict should change corresponsively.
