摘要
推行执业资格制度是我国转变专业技术人员管理方式的重要内容之一。它将强制性和灵活性有机地结合起来,既可以强化国家对专业技术人员的规范管理,又能够满足市场经济下应由市场机制发挥主要作用的要求。推行执业资格制度不但可以有效地开发、利用我国现有的专业人才资源,同时也有利于人才培养,为经济和科技发展所需的人才储备提供保障。本文对执业资格制度的内涵和实践进行全面地探讨和研究。深入分析执业资格制度的法理和法律基础。研究我国推行执业资格制度的环境、条件和步骤,根据实行执业资格制度的职业的特点和社会需要,提出近期我国应实行执业资格制度的职业;提出完整的国家执业资格制度体系框架。
Our country’s old professional technician management system was once designed for planning economy. It is too outdated to fit the new environment now with the society’s deeper development. Vocational Qualification License System(VQLS) then provides a new manner for our country’s professional technician management. It has characteristics of both enforceability and flexibility. With these characters it is possible to rule national professional technician management actives effectively by laws while emphasizing market power. We seriously discussed the VQLS from its theory and practice aspects in this paper. The definition and contents of VQLS are given. The legal origin and law bases of VQLS are deeply analyzed. We also fully analyzed our country’s social environment, necessary prerequisites and steps to carry out the VQLS. Based on these analyses, we recommend some vocations should be involved in VQLS recently. We also propose an integrated frame of national VQLS, including legislation frame, practice frame, vocation frame and scheme frame. It is not only a theory model but also a practice guidance to develop and carry out our country’s VQLS. This paper is helped to understand VQLS and provides practical policy suggestion.
