论行政决定公定力之起点

On Start Point of Administrative Decision's Presumed Validity

公定力是对行政决定的有效推定,而非合法推定。厘清行政决定公定力起点不仅有利于丰富公定力界限的讨论、完善公定力理论体系,而且有利于规范行政权的运行、保障相对人权利的行使。行政决定公定力的起点应当在行政决定成立之时,而不是生效之时。同时,行政决定公定力产生的起点与其他效力产生的起点存在差异。

Presumed validity is validity presumption but not legality presumption of the administrative decision. Clearing the start point of presumed validity not only can rich the discussion on its boundary and perfect its theory system,but also can rule the administrative power and protect the right of the private party in the administration. The start point of presumed validity is the moment of establishment of the administrative decision,but not the moment when the administrative decision comes into force. Meanwhile,the start point of presumed validity is different from other validity.
