论人权全球化及中国的对策

On the Globalization of Human Rights and Chinese Countermeasures

人权全球化,即是站在全球化的高度探讨人权问题。一国或者一个地区的人权问题上升到国际范围,任何国家或地区的侵犯人权的恶行都会引起国际社会的关注,遭到谴责、批判与干涉。人权全球化是一个过程,也是一个状态,它是随着全球化的发展以及国际社会、国际关系的进展而发展,并在这一发展过程中呈现出很多不同的特征与表现形式。人权全球化的大趋势已成为国际共识,但是关于人权的定义、实现方式、保障机制以及人权与主权的关系的争论与博弈却一直在以美国和欧洲为代表的发达国家与以中国为代表的发展中国家之间存在。在这一复杂的国际人权大环境下,中国政府面临着诸多挑战,在应对人权全球化的同时需要从国内外的多方面作出战略调整。

The globalization of human rights, namely, discussing human rights from globalizing views, has been an international issue, any human rights abuses in any country or any region would cause to be concered, criticized and interferenccd in the whole world. The globalization of humar, right experiences a long process and presents a status gradually with the development of globalization and the international society and relations, the globalization of human rights has its way and shows many different characteristics and forms. Nowadays, the trend has become an international consensus, but several debates about it still exist, such as the definition and its implementation, safeguard mechanism and the relationship between human fights and sovereign rights. Faced with such a complex international environment, China must make some strategic adjustments from acmal conditions inside and outside the country.
