2010年度中国法律方法论研究的一个显著特色是,转型中国法治出现对法律方法论的需求,以迎合法治时代的到来。不仅各种传统的法律方法备受重视,而且贴近中国法律运作实际与时代要求的实证研究逐渐增多,这显示出我国法律方法论研究开始繁荣。其主要表现在中国学者已经围绕着法治建设,开始构建与论证适合中国法治需要的法律方法体系和法律方法论体系,同时以更加精致的理论回应司法实践。法治似乎要走过粗放而进入细腻阶段,法律方法在法治建设中要发挥更大的作用。

The most distinct feature of research on legal methodology in 2010 is that legal methodology has become recognized as highly necessary for the rule of law in China in transition.In the past year great attention has been paid to the study of traditional subjects in legal methodology,such as legal interpretation and legal reasoning.Meanwhile,positive studies on legal practices have been growing constantly in number,suggesting the flourishing of the subject.Chinese scholars have started the construction of legal method system and its theories centering on the rule of law.In addition,they are putting forward better theories in response to judicial practices.We are confident that the rule of law will enter a new stage of intensitve study and legal methods will play a more important role in the construction of rule of law in China.
