我国物流业法制现状及其完善

THE LEGAL SITUATION OF CHINA'S LOGISTICS AND THE FUTURE REFORMATION ORIENTATION

近年来伴随我国物流高速发展而出现的物流制度问题日益凸显,尤其是物流法制体系的不健全,导致纠纷不断。要消除我国物流法律体制给物流发展带来的阻却,首先应全面考察我国物流产业和物流制度现状,找准突破口;然后充分借鉴国外先进物流立法经验,明确思路;之后,按照合理整合现行法律、有效补充法律缺失的思路,完善我国物流法制体系。

In recent years, accompanied by the rapid development of China＇ s logistms, the problems ot logastm system have become increasingly prominent, especially the imperfect legal system of logistics has resulted in constant disputes. To get rid of the drawbacks caused by our country＇ s legal system of logistics involves exami- ning comprehensively the status quo of China＇ s logistics industry and the logistics system and identifying a breakthrough. Advanced experience of logistic legislation in foreign countries can be used for reference so as to make clear our thinking and the present logistic legislation can be improved in accordance with reasonable inte- gration of existing laws and effective supplementing of the deficient laws.
